#HAPi 會員計劃條款與細則

 

 

Toby World Limited 以 #HAPi, Azona之名營業。

 

閣下參與 #HAPi 會籍須受以下 #HAPi 會員規則(以下稱為「本規則」)約束。當閣下申請 #HAPi 會籍時,即代表閣下已閱讀及同意本規則的條文及所包含的細則,並知悉本規則將作修訂而不作另行通知。

 

 

1.  #HAPi 會籍

 

1.1 #HAPi 會籍(以下稱為「本會籍」)歡迎所有年滿十五歲或以上人士參加。

 

1.2 #HAPi 會籍申請人須按 #HAPi 不時修訂之手續進行申請,包括但不限於填妥申請表格,及/或提供某些個人資料予 #HAPi 。#HAPi  將不處理未填妥或資料不正確的申請表。#HAPi 保留絕對權利,接受或拒絕任何會籍的申請,而毋須給予任何理由。

 

1.3 #HAPi 會員(以下稱為「會員」)必須於申請日期起計一星期內提交所需的個人資料,否則該會籍將會被暫時停止使用而不作另行通知,直至在所需資料補交後該會籍才會被重新啟動。

 

1.4 本會籍分為四種:綠色、黃色、粉紅色和藍色會籍,視乎該會員之選擇。

 

1.5 本會籍之有效期分為一個月、三個月和一年,視乎該會員之選擇。

 

1.6 會籍只屬於該會員擁有,不得轉讓予他人及只可在香港使用。

 

1.7 如有任何爭議,Toby World Limited 保留使用優惠條款及細則之最終決定權。

 

 

2. #HAPi 會員證

 

2.1 會籍申請被接納後,會員均會獲發電子會員證(以下稱為「會員證」)乙張。會員使用其會員證將被當作已接納本規則的條文。

 

2.2 會員證屬 #HAPi 所有。

 

2.3 會員證不得轉讓予他人使用。

 

2.4 會員須注意其會籍和會員證之有效期。

 

2.5 會員必須於購物、用餐及付款時,按相應情況出示其有效會員證,並以指定方式付款,方可享用會員購物及/或餐飲消費優惠。否則,#HAPi 有權拒絕該等人士享用本會籍任何相關優惠。

 

2.6 由於每位會員的會員證(相較其他事物外)為 #HAPi 用作識別會員身份的主要憑證,會員可憑證查核其會籍戶口,會員需妥善保管其會員證以及其他與其會籍相關的資訊以免遺失或遭未經授權使用。

 

2.7 會員如遇會員證及/或任何其他與其會籍相關的資訊遺失或被盜,或會員有合理理由相信其會籍或其帳戶及密碼可能遭未授權人士使用或被披露至未授權人士,會員必須立即向 contactus@hapi-fish.com 發送電郵、致電 #HAPi 熱線 +852 28113623,或親身到店內向職員報失,要求即時暫停閣下的帳號。

 

2.8 #HAPi 毋須就任何遺失或被盜的會員證或與會籍相關的資訊或裝置被未經授權使用所引起的損失及損害而承擔或負上任何法律責任。

 

 

3. 修訂

 

3.1 #HAPi 保留絕對權利修改本會籍、費用、各項優惠及其他特色,包括本規則,或於任何時間(不論是否發出通知)終止 #HAPi 會員計劃的運作;#HAPi 將不會為任何因此而引致的損失或損害負上法律責任。

 

3.2 有關的修訂將於店內公佈及/或公司網站內刊登而不另行通知,會員須自行查閱經修訂的規則。

 

3.3 會員繼續參與會籍計劃之活動或使用會員證將被當作已接納任何有關的修訂。如任何會員不同意有關修訂規則時,該名會員的唯一補救方法是即時停止參與會籍計劃之活動或使用會員證。

 

3.4 如有任何爭議,#HAPi 有絕對權力作出最終決定。

 

 

4. 費用

 

4.1 會員須繳付下列費用:

4.1.1 於申請入會時,會籍申請費;

4.1.2 於延續其會籍時,會籍申請費;及

4.1.3 於會員升級其會籍時,會籍差額費用。

 

4.2 所有已繳交之會籍費用將不會獲得發還。

 

4.3 所有會籍收費均以 #HAPi 訂立及決定為準。

 

 

5. 優惠

 

5.1 會員優惠可於線下門市和線上商店使用。

 

5.2 四類會員優惠分類如下:

5.2.1  持有綠色會籍之會員:只需登記成會員、毋須付費,任何消費均享有95折優惠;

5.2.2 持有黃色會籍之會員:登記並繳付指定會費後,均於餐廳享有尊屬優惠,而其他商品消費皆可享有基本95折優惠;

5.2.3 持有粉紅色會籍之會員:登記並繳付指定會費後,均於購物享有尊屬優惠,而於餐廳用餐皆可享有基本95折優惠;及

5.2.4 持有藍色會籍之會員:登記並繳付指定會費後,任何消費均享有尊屬優惠。

 

5.3 會員可透過繳付不同會籍之差額費用升級其會籍。升級方案如下:

5.3.1  持有綠色會籍之會員可升級至黃色、粉紅色或藍色會籍;

5.3.2  持有黃色會籍之會員不可轉為粉紅色會籍;

5.3.3  持有粉紅色會籍之會員不可轉為黃色會籍;及

5.3.4  持有黃色及粉紅色會籍之會員均可升級藍色會籍。

 

5.4 所有優惠將於會員之會籍屆滿或終止時被註銷。

 

5.5 會員如有行為不檢、詐騙、不正當使用會員證及/或其利益,或未能遵從本規則的條文將可導致其會籍及其相關優惠被即時終止。#HAPi 保留權利(不論是否發出通知)終止任何會員的會籍及及其相關優惠。

 

 

6. 個人資料/個人私隱

 

6.1 會員所提供的個人資料是供運作 #HAPi 會員計劃、會員優惠計劃及 #HAPi 不時為會員提供優惠而與其合作伙伴合辦之推廣等之用。如會員未能向 #HAPi 提供其個人資料,#HAPi 可能無法向會員提供上述服務。

 

6.2 會員同意 #HAPi 就所保存的會員個人資料作下列用途:

6.2.1 處理本會籍之申請;

6.2.2 會員管理系統的管理、運作及保養;

6.2.3 提供會員服務所涉之日常運作;

6.2.4 於會員證上印上會員名字;

6.2.5 由 #HAPi 向會員發放消息及提供資訊;

6.2.6 調查投訴、懷疑有可疑的交易及用作持續性的研究以改善服務及發展計劃;

6.2.7 設計供會員使用的服務或相關產品;

6.2.8 協助向會員提供優惠;及

6.2.9 根據法例規定,或其他法定機構所要求遵守的指引而作出披露。

 

6.3 會員同意 #HAPi 可能會將會員所提供的個人資料提供給下列人士(無論在香港或海外)作第 6.2 段所列出之用途:

6.3.1 向 #HAPi 提供行政、電訊、資訊科技系統、付款、印刷或其他與 #HAPi 業務運作有關的第三方服務供應者及其代理人及承辦商;

6.3.2 根據法律,或其他法定機構要求下,#HAPi 需向該人士遵守有關指引而需履行披露責任。

 

6.4 會員的個人資料均按照《個人資料(私隱)條例》管理。 

 

6.5 #HAPi 有意使用會員的姓名、聯絡資料及出生月份及年份以向會員發送有關 #HAPi 及/或 #HAPi 之特許銷售商及/或與 #HAPi 合辦推廣之合作伙伴的超市貨品、傢俬及家居用品、文儀玩具、時裝、飾物、服裝、皮具及行李、鞋履、鐘錶及珠寶、餐飲、飲食服務、媒體、娛樂、物流、運輸、旅遊及酒店、商場、信用卡、電訊、銀行、金融及保險服務、課程、會籍、會員計劃及 #HAPi 的關聯活動的消息、資訊、優惠及推廣資料(不論在店內或是網上)。

 

6.6 會員同意 #HAPi 可使用會員的個人資料作有關以上提及之宣傳和推廣用途。

 

6.7 如欲查閱或更正個人資料,或索取 #HAPi 所持個人資料類別的資料,請致函下列地址提出要求:#HAPi 上環普仁街 11 號 2 - 4 號地舖。

 

6.8 如會員未能向 #HAPi 提供更新的資料,#HAPi 有可能不會維持或延續其會籍,或提供相關優惠。會員有責任通知 #HAPi 其最新的聯絡電話、通信、電郵地址及其他聯絡方法之確實詳情。#HAPi 不會就因會員未能通知有關本規則的條文及所包含的細則的更改而導致的任何損失承擔任何責任。

 

 

7. 終止會籍

 

7.1 會員可於任何時間親臨店內向職員提交「#HAPi 會籍終止申請表」及/或註銷其會員證以終止其會籍,所有已繳交之會費等亦不獲發還。

 

7.2 會員如有行為不檢、詐騙、不正當使用會員證及/或其利益,或未能遵從本規則的條文將可導致其會籍及其相關優惠被即時終止。#HAPi 保留權利(不論是否發出通知)終止任何會員的會籍及及其相關優惠。

 

7.3 #HAPi 保留隨時全權酌情終止、停止、修改或取消會籍的權利而毋須通知閣下、提出理由及退款或賠償。

 

 

8. 法律責任

 

8.1 #HAPi 毋須就任何因本會籍、使用會員證或其利益,包括但不限於使用個人資料、任何人為錯誤或任何人以詐騙手段換取利益(不論 #HAPi 是否疏忽或其他原因引致)等的任何損失、損害或支出而對任何會員負上法律責任。

 

8.2 #HAPi 毋須就任何因其他組織與使用會員證所提供的產品或服務而引致的損失或損害負上法律責任。

 

8.3 #HAPi 對任何投訴或糾紛所作出的決定為最終的裁決,且對有關會員具有約束力;#HAPi 亦毋須就該決定給予任何理由。

 

 

9. 無效條文

 

9.1 如本規則中的任何條文在某司法管轄區的法律下屬無效、不合法或不可執行,將不會影響該條文在其他司法管轄區的有效性、合法性或可執行性,亦不會影響其他條文的有效性、合法性或可執行性。

 

 

10. 司法管轄權

 

10.1 本規則及 #HAPi 與各會員間的關係受到香港特別行政區法律的管轄。#HAPi 與各會員均同意接受香港法院非專有審判權的管轄。

 

 

**如有任何爭議,Toby World Limited 保留使用優惠條款及細則之最終決定權。

**假如本使用條款的所有或部分英文版與中文版本存在差異,應以英文版本為準。

#HAPi Membership Programme

Terms & Conditions


 

In Toby World Limited trading as #HAPi, Azona.

 

Your participation in the #HAPi Membership is governed by these #HAPi Membership Agreement Terms and Conditions. By applying for #HAPi Membership, you agree that you have read and agreed to the Membership Agreement Terms and Conditions and acknowledged the Membership Agreement Terms and Conditions will be amended without separate notice.


 

1. #HAPi Membership

 

1.1 #HAPi Membership (“the Membership”) is open to all persons who are 15 years of age or above.

 

1.2 Applicants of the Membership shall complete the application process as #HAPi may decide from time to time, including but not limited to completing an application form and/or providing certain personal data to #HAPi. Incomplete or inaccurate forms might not be processed by #HAPi. #HAPi reserves the right to approve or reject any application in its sole discretion without giving any reason.

 

1.3 #HAPi Membership Programme’s Member (“the Member”) must submit the required information within one week from the time of application. Otherwise, the Membership will be temporarily suspended without prior notification. The Membership shall be re-activated upon all required information has been received by #HAPi.

 

1.4 The Membership is available in four types: Green, Yellow, Pink and Blue, which depends on the Member’s choice.

 

1.5 The Membership is valid for one month, three months or one year, which depends on the Member’s choice.

 

1.6 The Membership belongs to the designated Member only, and is not transferable and is restricted for use in Hong Kong only.

 

1.7 In case of any disputes, Toby World Limited reserves the right of final decision on the terms and conditions of the use of the offer.

 

 

2. #HAPi Membership Card, Membership Account & Security

 

2.1 Upon acceptance of application, #HAPi will issue an electronic #HAPi Membership Card (“the Card”) to each Member. The use by the Member if his/ her Card constitutes acceptance of these terms and conditions.

 

2.2 The Card shall remain the property of #HAPi.

 

2.3 The Card is non-transferable.

 

2.4 Members shall be aware of the expiry date of his/ her Membership and the Card.

 

2.5 Members must present his/ her Card, as the case may be at the time of purchase with specific payment media to enjoy member shopping and/ or dining privileges. Otherwise, #HAPi reserves the right to reject him/ her of enjoying any related member privileges.

 

2.6 As each Member’s Card, among other things, is the principal means by which #HAPi identifies the Member and allows the Member access to the Member’s accounts, Members are advised to take good care of the Card and any other information relating to a Member's Membership with reasonable precautions against loss or unauthorised use.

 

2.7 If a Member’s Card and/ or any other information relating to a Member's Membership is lost or stolen, or the Member has sufficient reason to believe that his/ her Membership may have been used, or account and password have been disclosed to an unauthorised party, the Member must send us an email to contactus@hapi-fish.com with his/ her registered email information to request for temporary account suspension immediately, or contact the #HAPi at +852 28113623, or report to staff at store(s) in person.

 

2.8 #HAPi shall not be responsible or liable for any loss or damage arising from the unauthorised use of or access to the lost or stolen Card or information relating to a Member’s Membership.

 

 

3. Amendments

 

3.1 #HAPi reserves the rights, in its sole discretion, to modify the Membership, fees, benefits offered and other features, including these terms and conditions, or to terminate the #HAPi Membership Programme at any time with or without notice and #HAPi will not be liable for any loss or damages resulting therefrom.

 

3.2 #HAPi will post the amended terms and conditions at store(s) and/or on the company's website. #HAPi will not issue separate notice of amendment(s). Members are responsible for checking the amendment(s).

 

3.3 Continued participation in the Membership program will be deemed as acceptance of any amendment(s). If any Member does not agree with such amendment(s), such Member's sole remedy is to cease participating in the Membership program.

 

3.4 In case of any disputes, #HAPi has its sole discretion to make the final decision.


 

4. Fees

 

4.1 Members have to pay the following fees:

4.1.1 Application fees upon application of the Membership;

4.1.2 Application fees upon renewal of the Membership;and

4.1.3 Price difference between his/ her current Membership and the kind of Membership that he/ she would like to upgrade to, upon upgrading the Membership.

 

4.2 All fees are non-refundable in any circumstances.

 

4.3 Membership fees shall be determined by #HAPi.

 

 

5. Member Privileges 

 

5.1 Member privileges can be used in-store and on #HAPi online retail platform.

 

5.2 Member privileges of four types of Membership are as followed:

5.2.1  Green Membership:Members enjoy 5% off discount on all purchases once they have registered as Member, and membership fee is not applicable in this case;

5.2.2 Yellow Membership:Members enjoy VIP offers on dining service, while having basic 5% off on purchases of retail products (exclude dining service) once they have registered as Members and paid related membership fees;

5.2.3 Pink Membership:Members enjoy VIP offers on purchases of retail products made outside restaurant, while having basic 5% off on dining service once they have registered as Members and paid related membership fees;and

5.2.4 Blue Membership:Members enjoy VIP offers on all purchases, both dining and shopping inclusive, once they have registered as Members and paid related membership fees.

 

5.3 Members can upgrade their Membership by paying the price difference between his/ her current Membership and the kind of Membership that he/ she wishes to upgrade to. Possible plans of upgrade as followed:

5.3.1  Green Membership can be upgraded to Yellow, Pink and Blue Memberships;

5.3.2  Yellow Membership can not be switched to Pink Membership;

5.3.3  Pink Membership can not be switched to Yellow Membership;and

5.3.4  Yellow and Pink Memberships can both be upgraded to Blue Membership.

 

5.4 Member privileges will be invalid upon the expiry or termination of the Membership.

 

5.5 Misconduct, fraud, misuse of the Card and/ or its benefits or failure to follow these terms and conditions may result in the immediate termination of the Membership. #HAPi reserves all right with or without notice to terminate any Member’s Membership at which time without notice and all member privileges will be cancelled.

 

 

6. Personal Data & Privacy 

 

6.1 The personal data supplied by the Members are required for the operation of #HAPi Membership Programme and other privilege(s) which #HAPi may from time to time obtain from or arrange with our business partners in joint promotion for the benefit of the Members. Failure to supply personal data may result in #HAPi being unable to provide the above services to the Members.

 

6.2 The Member agrees that all the personal data provided to #HAPi and all information relating to the use of your Card may be used and retained by #HAPi for:

6.2.1 Processing an application for the Membership;

6.2.2 Management, operation and maintenance of the Membership management system;

6.2.3 Daily operation of the services provided to the Members;

6.2.4 Imprinting the Member's name on the Card;

6.2.5 Communication of news and information by #HAPi to Members;

6.2.6 Investigation of complaints, suspected suspicious transactions and ongoing research for service improvement and program development;

6.2.7 Designing services or related products for the Members' use;

6.2.8 Facilitating the issue of benefits to Members;and

6.2.9 Meeting the requirements to make disclosure under the requirements of any law binding or under and for the purposes of any guidelines issued by other statutory authorities with which #HAPi is required to comply.

 

6.3 Member further agrees that #HAPi may disclose and transfer Member’s personal data (whether within Hong Kong or abroad) to the following parties for the purposes as set out in Clause 6.2 above:

6.3.1 Third party service providers, their agents and contractors, who provide administrative, telecommunications, information technology system, payment, printing or other services to #HAPi in connection with the operation of its business including providing service to the Member and/or;

6.3.2 Any person to whom #HAPi is under an obligation to make disclosure under the requirements of any law binding or under and for the purposes of any guidelines issued by regulatory or other authorities with which #HAPi is required to comply.

 

6.4 Members' personal data will be managed in accordance with the Personal Data (Privacy) Ordinance.

 

6.5 #HAPi intends to use your name, contact details and month and year of birth to send you news, information, privileges and promotions (both in-store and online) regarding the following products and services offered by #HAPi and/or our license shops and/ or our business partners in joint promotion: supermarket goods, homeware, toys and stationery, fashion, accessories, clothing, leather goods and luggage, shoes, watch and jewellery, food and beverage, catering, media, entertainment, logistics, transportation, travel and hotel, shopping malls, credit cards, telecommunications, banking, financial and insurance, education, memberships, membership programmes and our associated events.

 

6.6 Member further agrees that #HAPi may use the Member’s personal data for marketing and promotional purposes stated above.

 

6.7 All requests for access to or correction of personal data or information regarding practices and types of personal data held should be in writing addressed to #HAPi store: Shop 2-4, G/F,  Tower 125, No.11 Po Yan Street, Sheung Wan, Hong Kong.

 

6.8 #HAPi may be unable to maintain or renew a Membership or the associated benefits if the Member fails to provide #HAPi with up to date information. Members are responsible for keeping #HAPi informed of their new telephone contact, correspondence and email addresses. #HAPi is not responsible for any loss as a result of the Member's failure to inform #HAPi of any change.

 

 

7. Termination of Membership

 

7.1 Member may terminate his/ her Membership at any time by submitting < #HAPi Membership Termination Requisition Form>, and/ or cancelling his/ her Card. Membership fees paid will not be refunded on termination of the Membership.

 

7.2 Misconduct, fraud, misuse of the Card and/ or its benefits or failure to follow these terms and conditions may result in the immediate termination of the Membership. #HAPi reserves all right with or without notice to terminate any Member’s Membership at which time without notice and all member privileges will be cancelled.

 

7.3 #HAPi reserves all right of terminating, cancelling and amending the Membership, without giving any notice, reason and refund and compensation.

 

 

8. Liability 

 

8.1 #HAPi shall not be liable to any Member for any loss, damages or expenses of any kind whatsoever arising out of or in connection with the Membership, the use of the Card or their benefits, including but not limited to the use of personal data, mistakes or fraud by any person redeeming a benefit, whether #HAPi is negligence or otherwise. 

 

8.2 #HAPi will not be liable for any loss or damage arising out of the product or service provided by any other entities in connection with the use of the Card.

 

8.3 #HAPi’s decision on respect of any such complaint or dispute shall be final and binding on the Member and #HAPi shall not be required to give any reason for such decision.

 

 

9. Invalid provisions

 

9.1 The invalidity, illegality or unenforceability of any provision of these terms and conditions under the laws of any jurisdiction shall not affect its validity, legality or enforceability under the laws of any other jurisdiction nor the validity, legality or enforceability of any other provisions herein contained.

 

 

10. Jurisdiction

10.1 These terms and conditions and the relationship between #HAPi and each Member are governed by the laws of The Hong Kong Special Administrative Region. #HAPi and each Member submit to the non-exclusive jurisdiction of the Hong Kong Courts.

 

 

** In case of any disputes, Toby World Limited reserves the right of final decision on the terms and conditions of the use of the offer.

 

**If there is any inconsistency between the English version and the Chinese version of the Terms and Conditions, the English version shall prevail.
